Terms of Service
Last updated: 12 September 2026
1. Acceptance
These Terms of Service (“Terms”) govern your use of the Klems AI website at klemfy.app, the Klems AI mobile application, and related services (together, the “Service”). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is operated by Klemfy Recovery Solutions LTD (“Klemfy Recovery,” “we,” “us”), a company in Nigeria. Klems AI is the product name for the Service.
2. Eligibility
You must be at least 18 years old and able to enter a binding contract under Nigerian law. By creating an account or joining the waitlist you confirm that you are. The Service is built for money claims that may qualify for Lagos Small Claims. We may refuse or close an account if we reasonably believe you do not meet these requirements.
3. Account
You may sign up with email, phone, Apple, or Google. You are responsible for your login details and for activity on your account. Keep your information accurate. Tell us at collection@klemfy.app if you think someone else used your account.
4. What Klems AI is — and is not
Klems AI helps you describe a money claim, checks whether it looks like a Lagos-to-Lagos Small Claims matter, and lets our desk pursue recovery. A demand letter is prepared as a counsel template. Our desk sends it. You do not write or send the letter yourself.
Klems AI is not your solicitor. Using the Service does not create a lawyer–client relationship with Klems AI, with Klemfy Recovery, or with any counsel we instruct. We do not promise that money will be recovered, that a court will accept a filing, or that the other party will pay.
5. Recovery mandate
Before we start recovery on a likely claim, the app shows a recovery mandate. You must read it, tick the box, and tap I agree we keep 10%. Chat “yes” does not count. The words on that screen are stored with your claim. That mandate is a separate instruction to Klemfy Recovery. It sits alongside these Terms; it does not replace them.
By accepting the mandate you authorise Klemfy Recovery to receive payment from the other party into the firm account, to deduct the success fee, and to pay the rest to the payout account you gave us. Your payout account number is not printed on the demand letter.
6. Fees
Unless a later mandate says otherwise:
- An operations fee of ₦5,000 is due after you agree, to start the claim. You usually pay this through Paystack. If checkout is down, staff may record the fee as paid by hand. This fee is for starting the file. It is not a court filing fee.
- If money is recovered, Klemfy Recovery keeps 10 percent of what is recovered and pays you the rest. The naira example on the mandate is illustrative of the claim amount then on file.
Those amounts lock when you first accept the mandate. We do not automatically transfer money to you. Staff record a recovery and mark you paid by hand after the firm has received funds.
The other party is asked to pay Klemfy Recovery, not you directly. Paystack is used only for your operations fee. We do not use Paystack to pull money from the other party or to pay you out.
The operations fee is not refunded after the desk has sent a demand or started recovery. If we refuse the claim or never send a letter for a reason that is not yours, we will refund the operations fee. Email collection@klemfy.app if you want us to stop.
7. Your claim and your conduct
You agree to:
- Pursue only claims you believe are genuine.
- Give accurate facts, amounts, names, and contact details for the other party, and only share those details if you are allowed to.
- Upload only files you are allowed to share (receipts, contracts, messages).
- Give a real bank account in your name (or that you are authorised to use) for any payout.
You must not use the Service to harass anyone, to invent a debt, or to break the law. We may pause or close a claim or account if we reasonably believe these Terms are broken.
8. Evidence and AI
You keep ownership of the story and files you submit. You give us a licence to store, review, and use them to run the Service — including drafting papers, sending a demand, and instructing counsel.
Klems AI uses automated tools (including third-party language models) to extract facts and draft text. Those tools can be wrong. You should check what is on your claim file. We may also write counsel-style particulars from your file. We instruct the model not to invent names or amounts; a draft can still be wrong. If it looks wrong, tell the desk.
9. Desk, letters, and court
Our desk decides when a letter goes out. We will not send a demand unless the claim is likely for Lagos Small Claims, your payout account is on file, you have accepted the mandate, the operations fee is paid, and a live firm account is set for the letter.
Serving the letter, waiting fourteen days, and any later court filing are operations steps. The Service does not itself file at court. Time limits and court rules are outside our control.
10. Third-party services
Sign-in may use Apple or Google. Payments for the operations fee use Paystack. Chat and drafts may use our model providers. Their terms also apply to their part of the path. We are not responsible for outages on those services.
11. Intellectual property
Klems AI, the site, the app, and our templates belong to us or our licensors. You may not copy, scrape, or resell the Service. You may keep copies of papers we generate for your own claim.
12. Disclaimer
The Service is provided “as is.” We do not warrant that recovery will succeed, that the app will always be available, or that drafts are complete for every court. Eligibility for Small Claims depends on facts (including that both sides are in Lagos and the amount is a liquidated sum at or under the cap). If we say a claim is unlikely, we will not send a Small Claims demand for it.
13. Liability
To the fullest extent Nigerian law allows, we are not liable for lost profits, lost recovery, or indirect loss from your use of the Service. Our total liability for a claim is limited to the operations fee you paid us on that claim, or ₦5,000 if none was paid.
Nothing in these Terms excludes liability that cannot be excluded under Nigerian law, including for fraud.
14. Closing your account
You may ask us to close your account by emailing collection@klemfy.app. We may suspend or close access if you break these Terms or if we stop offering the Service. How we keep or delete data is described in the Privacy Policy.
15. Changes
We may update these Terms. The date at the top will change. For a material change we will try to tell you in the app or by email. Continued use after the update means you accept the new Terms. A mandate you already accepted stays the wording we froze on that claim.
16. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be heard in the courts of Lagos State, unless a mandatory rule says otherwise.
